Finally…….Project Client fined for breach of CDM
And about time too!
A property company has been ordered to pay £11,000 in fines & costs for failing to manage a construction project properly & breaching CDM 2007
The property company hired a contractor to manage the renovation of an old factory site; the contractor then sub-contracted an unskilled labourer to carry out the work. The labourer fell through a fragile roof whilst inspecting it suffering fractures to his vertebrae and serious injuries to his hands
The property company, as the Project Client, had not appointed a CDM Co-ordinator or Principal Contractor, had no suitable management arrangements in place and failed to check the contractor’s competence.
The contractor failed to ensure the work was properly planned, appropriately supervised and performed in a safe manner
City of London Magistrates Court fined the Client £7,000 in fines plus £4486 costs for offences under Reg 4 (Competence) & Reg 9 (Clients duty in relation to arrangements for managing projects) of CDM 2007
